This Privacy Policy (the “Policy”) becomes effective on June 15, 2019 for all users. HPS collects data directly from you to help provide you with the best experiences with our services and products. HPS may collect information from you in three ways; 1) through websites operated by HPS, 2) your use of our services, and 3) information you provide.

 

Websites operated by HPS

In connection with visiting any HPS owned website, HPS may use third party services to collect and store information.

 

Your use of our Services

When using or interacting with a HPS product or service, HPS may collect information about your interactions, the services you use and how you use them. Information collected may include; device information, location information, unique application ID’s, cookies and similar technologies.

 

Information you provide
 

  • HPS Customers: Some HPS services may require you to sign up for an account. When you sign up for the account, we may ask you for some personal information such as your name, email address, company name and company information.
  • HPS Customer Clients: Some data requested by our Customers, through the use of our services (i.e forms), is personally identifiable information, which may include, but not limited to, your name, address, telephone numbers, e-mail address, company name, and company information. This information will be input by you in response to prompts when using our Customer’s websites.

 
Types of Information NOT Collected 

 

The following personal information is restricted from being collected through the use of our services and you should refrain from providing any information related to financial information such as, but not limited to, credit card and account numbers, Social Security number, driver’s license number, passport number, and information protected by the Family Educational Rights and Privacy Act (“FERPA”), the Gramm Leach Bliley Act (“GLBA”), Health Insurance Portability and Accountability Act (“HIPAA”) and/or Social Security Number Protection Act.

 

Information We May Place on Your Computer 

 

HPS software may store some information on your computer. This information will be in the form of a “Cookie” or similar file and will help us and our customer in many ways. A Cookie is an element of data that a web site can send to your browser, which may then store the Cookie on your hard drive. If a Cookie is stored on your computers hard drive, the next time you visit the same website, we can recognize you. For example, Cookies are used to better match your interests and preferences. With most Internet browsers, you can erase Cookies from your computer hard drives, block all Cookies, or receive a warning before a Cookie is stored. Web Beacons 

 

We use web beacons alone or in conjunction with Cookies to help collect information that enables us to track the existence and/or nature of web-based interactions that take place via our customer’s websites. Web beacons help us to analyze where users go and what they do while visiting our customer’s websites. A web beacon is a clear electronic image. A web beacon will recognize certain types of information on your computer, such as cookies, when you view a website that is connected to that web beacon. We may also use anonymous information about your visits to our customer’s websites in order to improve our customer’s products and services and help them provide relevant and useful information about goods and services of interest to you.

 

IP Addresses
 

HPS automatically records certain information, which may include your web request, your interaction with a service, the Internet Protocol address of the computer from which you are accessing the website, your browser type, browser language, and the date and time of your request.

 

EEA Resident Rights
 
If you are a resident of the European Economic Area, you have the following data protection rights:

  • If you wish to access, correct, update or request deletion of your personal information, you can do so at any time by contacting us.
  • In addition, you can object to processing of your personal information, ask us to restrict processing of your personal information or request portability of your personal information.
  • You have the right to opt-out of marketing communications we send you at any time. You can exercise this right by clicking on the “unsubscribe” or “opt-out” link in the marketing emails we send you.
  • Similarly, if we have collected and processed your personal information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.

We respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws. Notwithstanding the foregoing, we reserve the right to keep any information in our archives that we deem necessary to comply with our legal obligations, resolve disputes and enforce our agreements.

 

Opt-Out
 
If you do not wish to have your personally identifiable information collected, then you should not use the customer website or you should make use of any tools the customer provides, if any, for opting out of the collection of your personally identifiable information. You may contact customers directly, outside of the website, to make alternate arrangements to provide them with applicable information.

 

Accountability For Onward Transfer

HPS may use agents to perform services on our behalf. We may share with these agents information input by you solely for the purpose of those agents performing services for HPS. These parties are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution if they fail to meet these obligations.

HPS complies with the Privacy Shield for all onward transfers of personal data from the EU and Switzerland, including the onward transfer liability provisions.

 

Security
 
HPS takes appropriate steps to ensure data privacy and security including through various hardware and software methodologies. These include internal reviews of our data collection, transmission, storage, and processing practices, as well as encryption and physical security measures to guard against unauthorized access to systems where we store the information we collect.

 

Data Integrity and Purpose
 
Except as otherwise stated below, we do not sell, trade or rent your personally identifiable information collected on the site to others. When you do provide us with personally identifiable information, we may use it as follows:

  • Our customers have access to all personally identifiable information collected through their websites and they may use and disclose such personally identifiable information in accordance with their privacy policies.
  • Our service providers, if any, have access to the information we collect in order to help us deliver our service to our customers.

  • We may disclose the information to third parties when we believe in good faith that such action is necessary to enforce any legal terms or conditions that may apply to usage of this website or our customer’s websites.

HPS and our customers may use non-personal “aggregated data” to enhance the operation of our software, our customer’s websites, or analyze interest in the areas, or the efficacy of those websites. HPS provides its customers with reasonable mechanisms to ensure that personal identifiable information is relevant to its intended use, accurate and complete.

Please note, HPS may disclose personal information in response to lawful requests by public authorities in order to meet any national security or law enforcement requirements.

 

Access 
 
Upon written request to [email protected] and with consent from our customer, HPS will take reasonable steps to permit you to correct, amend, or delete your personal information that is demonstrated to be inaccurate or incomplete. Please note, permission must be obtained by our customer before any changes may be made.

 

Enforcement and Liability 
 
HPS shall conduct periodic audits as it relates to its obligations and compliance under this Policy. Any isolation of this Policy will be subject to disciplinary action up to and including termination of employment.

 

Dispute Resolution

HPS is a SaaS provider and does not control nor is liable, in any way, for the uses to which our customers may make of personal information you have provided to them.

 

Modifications for the Privacy Policy 
 
HPS reserves the right to modify its privacy policy at any time and will notify you by posting an amendment to the privacy policy on our website. Such modifications will become effective on the day they are posted. HPS encourages you to frequently review the privacy policy for any modifications.
